Reference in Christ Church Parish, Middlesex Co., VA as the parents of Ann Paine.
The first definite mention of Barnett Paine was the 1704 Quit Rent Roll for King and Queen Co.,
VA at that time he owned 130 acres. By 1718 Barnett Paine had increased his land holdings to
350 acres. Barnett Paine was involved in numerous land transactions in K & Q Co., and, when
Spotsylvania Co was formed in 1720 from Essex, King William, and King & Queen Co. He was
involved in numerous land transactions there. He remained a resident of King and Queen Co.,
until his death about 1742 or 1743.
Before his death Barnett Paine served as the administrator of the estate of his son, Barnett Paine,
Jr. He lived at one time in Spotsylvania in 1724 next to Lawrence Franklin. Franklin ancestors
were named Bernard.
Supposedly the sons migrated from Spotsylvania Co., VA to Burke Co., NC in the mid to late
1700's.

(b ca 1739) moved to Orange Co. about 1775, he may have still held title to land in
Spotsylvania or moved back there although his will was probated in Orange Co. However,
this may be his son or certainly another Paine line. A note on this list states that there
were only 704 whites (free males) in 1783; however another note states that there were
5,171 whites on
the 1790 census for this county.

He served 3 enlistments in the Revolutionary War. "He was in the trenches under
command of Lafayette when Cornwallis surrendered." (Smith Ferguson Paine's Memoirs)
On 16 April 1783 Robert and Rachel Lord Paine sold their property in Spotsylvania
County, VA. (Robert's interest in his father's estate) Robert and his family lived in
Culpepper County, VA from 1783 to 1789.
About March 1789 Robert & family moved to NC, settling first in Lincoln Co., and then on
the Little River in Burke (now Alexander) Co.
Robert was listed on the 1790 Lincoln County, NC census and on the 1800 Burke County,
NC census.
Alexander Co., NC Family Heritage Book (603) on page 425 lists a history of Robert
PAINE (Sr.) and Rachel LORD: "Robert Paine was born before 1755 in Spotsylvania Co.,
VA, son of John Pain/Paine and his wife, Frances Coleman. His wife was Rachel Lord
who was also from Virginia. They were married about 1770. On April 16, 1783 Robert and
Rachel Lord Paine sold their property in Spotsylvania County. Robert Paine and his family
lived in Culpeper County, VA from 1783 to 1789 when they moved to North Carolina. In
NC they first settled in Lincoln County and then on to Burke County where Robert Paine
took up land on the Catawba River between upper and middle little River in what is now
Alexander County, NC Robert Paine died in Burke Co., NC in 1805, but it is not known
when Rachel Lord Paine died. Robert and Rachel Lord Paine had 10 children....."

Memoirs by grandson, Smith Ferguson PAINE: "The Paines were of English descent.
My grandfather, Robert B. Paine, was a Virginian. His wife, Rachel Lord, was also a
Virginian. To them was born a large family of three sons and seven daughters.
Grandfather Robert B. Paine lived in Virginia until after the close of the Revolutionary
War. He then moved to Burke County, N.C. (now Alexander County, N.C.) and settled on
the upper Little River in March of 1789. He died there not many years later.
Robert B. Paine served three enlistment's in the Revolutionary War. He was in the
trenches under the command of Lafayette when Cornwallis surrendered at Yorktown."

Memoirs by Smith Ferguson PAINE: "Daniel Paine, the eldest son, settled near
Memphis, Tenn. He had an only son, named Mycager. Father and son were both
soldiers in the War of 1812, and were at the Battle of New Orleans. Some years
after this battle, he visited his old home in North Carolina. When he was asked
how the Battle of New Orleans came out, he said; "All right, America got the beef
and England got the lead". "
They moved to Maury Co., TN from Burke Co., NC about 1812.
Lived in Maury Co., TN. He settled near Memphis, TN.
"Nancy Paine was still living in 1860 census where she was counted twice - once
in Mary Beasley (now Veatch) household and once in her grandson, Eli Beasley
household. Eli wrote his will in 1862 and in it, he made reference to his "mother's
dower" as if it was still in limbo. Seems to mean that Nancy was still alive, so
Daniel's estate never settled and so had not come to Mary yet either. Nancy not
in Maury Co. in 1870 census -probably she had died before that.
Micajah was the oldest son. He was named first on the will of Daniel written in
1839. I think Micajah was born about Sept of 1790, since we now know that
Daniel and Nancy were married in Dec 1789 and they have one child already on
that 1790 census. Micajah married in Sept of 1810 and Daniel signed the
marriage as did George Allen. I looked on the 1810 census of Burke Co. and
George Allen lives nearby Daniel Payne. The numbers shown indicate Micajah
was still at home and George Allen has 4 daughters the right age of Elizabeth.
Anyway, I think he was 20 when he married.

Also, Micajah sold his land in Maury Co., TN in 1841 and I think he fully intended
to migrate West with his sons. I think he and Elizabeth did in fact leave
Tennessee and probably stayed in Arkansas for a while as did the others. I think

marriage records there where she remarried to Timothy Hughes on May 7, 1850

Payne, sons. She is 59 b. NC and Timothy is 56 b. Unknown - think he's from
Rowan Co., NC. They are gone by 1860 and I've never found a trace of them."

Daniel Paine - War of 1812
National Archives Records Administration (NARA) Bounty Land Warrant
Application #29270 and #14335 issued from applications filed in Maury Co., TN
by Nancy Paine, Widow of Daniel Paine on 4 February 1851 and 31 March 1855
for 80 acres each. There is no indication where this land was located, but the
second application indicates she sold the first 80 acres and probable she sold the
second parcel as well. A separate request to the Gov. Land Office, Washington
DC will have to be made to discover the locations of the land.

On this 4 day of February one Thousand eight hundred and fifty one, Personally
appeared before me a Justice of the Peace for the County and State aforesaid,
Nancy Payne, age 78 years a resident of Maury County in the State of
Tennessee, who being duly sworn according to Law, declares that she is the
widow of Daniel Pain, who was a Private in the company commanded by Captain
James McMahon in the Regiment of Tennessee Volunteers commanded by Col.
Lauderdale in Coffee's Brigade in the war with Great Britain declared by the
United States June 18, 1812. That her said husband volunteered in Maury County
Tennessee on or about the 3rd day of October 1814 for the term of six months
and continued in actual service in said war for the term of six months and was
honorably discharged at Columbia Tennessee on or about the 24th day of April
1815 as will appear by reference to the Master Roll of said Company; she not
knowing what he done iwth his certificate of discharge.
She further states that she was married to the said Daniel Pain in the State of
North Carolina in Burke County on the 24th day of December 1789 by one Elidge
a Minister of the Gospel and that her name before said marriage was Nancy Pain,
that she and her said husband were cousins, that her said husband died in Maury
Co. in the state of Tennessee on the 6th day of December A.D. 1839 and that
she is still his widow. She further states that she knows of no public or private
record of their marriage. She makes this declaration for the purpose of obtaining
the bounty land to which she may be entitled under the act passed September
28th, 1850.

lived together for many years in their immediate neighborhood as man and wife
and were undoubtedly such, that they raized a family of children, that Daniel Pain
dec'd at the time said further in the application and that Nancy Pain still continues
as widow. We have often visited the family in the lifetime of Daniel Pain and
always knew him and Nancy Pain to live together as man and wife. Sworn to and

Nancy Payne, that her said husband died in Maury Co., Tennessee on the 10th
day of December A.D. 1841 and that she is now a widow. That there is no known
public or private record of their marriage.

She further declares that she made application for bounty land under the act
approved September 28, 1850 and received a land warrant for 80 acres which
she has since legally disposed of and it cannot now be returned. She makes this
declaration for the purpose of obtaining an additional bounty land to which she
may be entitled under the act approved March 3, 1855.
We, James P. Adkins and Jas. H. Pasmore residents of said State and County,
declare upon our oaths that we personally know Nancy Payne who signed and
acknowledged the foregoing declaration in our presence, during the lifetime of her
said husband Daniel Payn, deceased and we knew them when the said Daniel
Payn died as about the time before stated and that we know that she is now a
widow and we are satisfied that she is the identical and lawful widow of the said
Daniel Payn deceased and that he served as above stated, that we are
disinterested.

Reference in Christ Church Parish, Middlesex Co., VA as the parents of Ann Paine.
The first definite mention of Barnett Paine was the 1704 Quit Rent Roll for King and Queen Co.,
VA at that time he owned 130 acres. By 1718 Barnett Paine had increased his land holdings to
350 acres. Barnett Paine was involved in numerous land transactions in K & Q Co., and, when
Spotsylvania Co was formed in 1720 from Essex, King William, and King & Queen Co. He was
involved in numerous land transactions there. He remained a resident of King and Queen Co.,
until his death about 1742 or 1743.
Before his death Barnett Paine served as the administrator of the estate of his son, Barnett Paine,
Jr. He lived at one time in Spotsylvania in 1724 next to Lawrence Franklin. Franklin ancestors
were named Bernard.
Supposedly the sons migrated from Spotsylvania Co., VA to Burke Co., NC in the mid to late
1700's.

On 16 April 1783 Robert and Rachel Lord Paine sold their property in Spotsylvania
County, VA. (Robert's interest in his father's estate) Robert and his family lived in
Culpepper County, VA from 1783 to 1789.
About March 1789 Robert & family moved to NC, settling first in Lincoln Co., and then on
the Little River in Burke (now Alexander) Co.
Robert was listed on the 1790 Lincoln County, NC census and on the 1800 Burke County,
NC census.
Alexander Co., NC Family Heritage Book (603) on page 425 lists a history of Robert
PAINE (Sr.) and Rachel LORD: "Robert Paine was born before 1755 in Spotsylvania Co.,
VA, son of John Pain/Paine and his wife, Frances Coleman. His wife was Rachel Lord
who was also from Virginia. They were married about 1770. On April 16, 1783 Robert and
Rachel Lord Paine sold their property in Spotsylvania County. Robert Paine and his family
lived in Culpeper County, VA from 1783 to 1789 when they moved to North Carolina. In
NC they first settled in Lincoln County and then on to Burke County where Robert Paine
took up land on the Catawba River between upper and middle little River in what is now
Alexander County, NC Robert Paine died in Burke Co., NC in 1805, but it is not known
when Rachel Lord Paine died. Robert and Rachel Lord Paine had 10 children....."

Memoirs by grandson, Smith Ferguson PAINE: "The Paines were of English descent.
My grandfather, Robert B. Paine, was a Virginian. His wife, Rachel Lord, was also a
Virginian. To them was born a large family of three sons and seven daughters.
Grandfather Robert B. Paine lived in Virginia until after the close of the Revolutionary
War. He then moved to Burke County, N.C. (now Alexander County, N.C.) and settled on
the upper Little River in March of 1789. He died there not many years later.
Robert B. Paine served three enlistment's in the Revolutionary War. He was in the
trenches under the command of Lafayette when Cornwallis surrendered at Yorktown."

Memoirs by Smith Ferguson PAINE: "Daniel Paine, the eldest son, settled near
Memphis, Tenn. He had an only son, named Mycager. Father and son were both
soldiers in the War of 1812, and were at the Battle of New Orleans. Some years
after this battle, he visited his old home in North Carolina. When he was asked
how the Battle of New Orleans came out, he said; "All right, America got the beef
and England got the lead". "
They moved to Maury Co., TN from Burke Co., NC about 1812.
Lived in Maury Co., TN. He settled near Memphis, TN.
"Nancy Paine was still living in 1860 census where she was counted twice - once
in Mary Beasley (now Veatch) household and once in her grandson, Eli Beasley
household. Eli wrote his will in 1862 and in it, he made reference to his "mother's
dower" as if it was still in limbo. Seems to mean that Nancy was still alive, so
Daniel's estate never settled and so had not come to Mary yet either. Nancy not
in Maury Co. in 1870 census -probably she had died before that.
Micajah was the oldest son. He was named first on the will of Daniel written in
1839. I think Micajah was born about Sept of 1790, since we now know that
Daniel and Nancy were married in Dec 1789 and they have one child already on
that 1790 census. Micajah married in Sept of 1810 and Daniel signed the
marriage as did George Allen. I looked on the 1810 census of Burke Co. and
George Allen lives nearby Daniel Payne. The numbers shown indicate Micajah
was still at home and George Allen has 4 daughters the right age of Elizabeth.
Anyway, I think he was 20 when he married.

Also, Micajah sold his land in Maury Co., TN in 1841 and I think he fully intended
to migrate West with his sons. I think he and Elizabeth did in fact leave

Rowan Co., NC. They are gone by 1860 and I've never found a trace of them."

Application #29270 and #14335 issued from applications filed in Maury Co., TN
by Nancy Paine, Widow of Daniel Paine on 4 February 1851 and 31 March 1855
for 80 acres each. There is no indication where this land was located, but the
second application indicates she sold the first 80 acres and probable she sold the
second parcel as well. A separate request to the Gov. Land Office, Washington
DC will have to be made to discover the locations of the land.

On this 4 day of February one Thousand eight hundred and fifty one, Personally
appeared before me a Justice of the Peace for the County and State aforesaid,
Nancy Payne, age 78 years a resident of Maury County in the State of
Tennessee, who being duly sworn according to Law, declares that she is the
widow of Daniel Pain, who was a Private in the company commanded by Captain
James McMahon in the Regiment of Tennessee Volunteers commanded by Col.
Lauderdale in Coffee's Brigade in the war with Great Britain declared by the
United States June 18, 1812. That her said husband volunteered in Maury County
Tennessee on or about the 3rd day of October 1814 for the term of six months
and continued in actual service in said war for the term of six months and was
honorably discharged at Columbia Tennessee on or about the 24th day of April
1815 as will appear by reference to the Master Roll of said Company; she not
knowing what he done iwth his certificate of discharge.
She further states that she was married to the said Daniel Pain in the State of
North Carolina in Burke County on the 24th day of December 1789 by one Elidge
a Minister of the Gospel and that her name before said marriage was Nancy Pain,
that she and her said husband were cousins, that her said husband died in Maury
Co. in the state of Tennessee on the 6th day of December A.D. 1839 and that
she is still his widow. She further states that she knows of no public or private
record of their marriage. She makes this declaration for the purpose of obtaining
the bounty land to which she may be entitled under the act passed September
28th, 1850.

Court of Maury }
On this 31 day of March A.D. one Thousand eight hundred and fifty five
personally appeared before me a Justice of the Peace within and for the State
and county aforesaid, Nancy Payne, age 82 years a resident of Maury County
State of Tennessee who being duly sworn according to Law, declares that she is
the widow of Daniel Payne deceased, who was a Corporal in the company
commaded by Captain McMahon in the Regiment of Tennessee Volunteers
commanded by Col. Lauderdale & Dyre in Coffees Brigade in the war with Great
Britain declared by the United States June 18, 1800, that her said husband
volunteered in Maury Co., Tennessee about the 1st day of September A.D. 1814
for the term of six months and entered in actual service in said war for the term of
six months and was honorably discharged at Columbia Tennessee about the 15th
day of April A.D. 1815. She further declares that she was married to the said
husband in Burk County North Carolina on the 24th day of December A.D. 1789
by one Elidge - - - a Baptist Minister and that her name before said marriage was
Nancy Payne, that her said husband died in Maury Co., Tennessee on the 10th
day of December A.D. 1841 and that she is now a widow. That there is no known
public or private record of their marriage.

She further declares that she made application for bounty land under the act
approved September 28, 1850 and received a land warrant for 80 acres which
she has since legally disposed of and it cannot now be returned. She makes this
declaration for the purpose of obtaining an additional bounty land to which she
may be entitled under the act approved March 3, 1855.
We, James P. Adkins and Jas. H. Pasmore residents of said State and County,
declare upon our oaths that we personally know Nancy Payne who signed and
acknowledged the foregoing declaration in our presence, during the lifetime of her
said husband Daniel Payn, deceased and we knew them when the said Daniel
Payn died as about the time before stated and that we know that she is now a
widow and we are satisfied that she is the identical and lawful widow of the said
Daniel Payn deceased and that he served as above stated, that we are
disinterested.
